Website Terms and Conditions

You agree to be bound and abide by the Terms and Conditions mentioned herein below by using or accessing this website.

Eighty Twenty Design and Communication reserves its right to modify/alter the terms, conditions and other information provided (ii) discontinue the website/services (iii) terminate/suspend your access/account, at its discretion, without prior notice and without any liability to you or any third party.

In the event of any modification or alteration, the same shall be effective immediately and carried out without prior notice. Using/accessing the website after such modification shall be construed as sufficient acceptance of such modification/alterations. Hence frequent review of the terms and conditions are recommended. If you do not agree to the terms and conditions, you may stop using the website/services.

Where you access, read or use the website on behalf of any entity, you agree to indemnify Eighty Twenty Design and Communication on the entity’s behalf, in the event of any breach or violation of the terms and conditions herein.

Eighty Twenty Design and Communication: Is the registered company name henceforth refereed as the8020

Brand / Company: This is the entity for which all collateral will be designed for, ie. all designed material will carry its logo.

The entity should be legal and can be a stand-alone brand or can come under a registered company.

Subscriber: The person who subscribes to the Social Media Design Package on behalf of a brand / company. This person may do so only on official and legal capacity and formally authorised by the brand / company. This is the person who the8020 will be in touch with to coordinate for all the artworks henceforth. A formal letter must be submitted to change the point of contact with appropriate contact details requested by the8020 at that time. The term subscriber also includes the brand / company he/she represents.

Subscription: Brand / company pay a subscription fee to enrol into the yearly social media design package plan offered by the8020.

Subscription Fee: Fee paid by the brand / company to enrol into the social media design package.

Subscription period: The period during which subscription is paid for.

Festival / Event: Festivals listed by the8020 such as Diwali, Christmas etc

Extra Posts: Extra posts offered by the8020 for a subscription apart from the Festival Posts

Artwork or Design: A designed social media post delivered to the brand / company.

the8020 cannot verify the legality of the registration or nature of the company so the8020 will be indemnified from it.
All subscription will be treated for one brand / company only. the8020 will not add 2 or more brand logos into any 1 artwork.
All design will be sent prior to the festival and the design as such cannot be changed but may be altered.
Any design change can be accepted or denied by the8020
the8020 is not responsible for posting the design in the respective company's social feed.
Once the design is sent the brand / company must revert within 2 days for any changes relating to that festival post.
If the brand / company does not respond in 2 days then the artwork is by default approved by the brand / company
Feedback received 1 day prior to the event or on the day of the event may or may not be accepted by the8020.
the8020 holds all rights to reject any feedback.
The package is aimed at providing good quality design accessible to many small and medium scaled businesses only.
the8020 retains all right to terminate a subscription immediately or on any later date without prior notice.
The brand or the company cannot hold the8020 responsible for any delay in delivery due to unforeseen circumstances and the brand or the company indemnifies the8020 against any legal action.
If a subscription is terminated the8020 may refund any balance available to the brand / company through a preferred payment method of the8020.
the8020 may retain the subscription fee on proper grounds and will inform the brand / company of the same.
the8020 cannot be held responsible for any delays arising from online payments.
The subscription form is an integral part of the process and the Subscription will begin only when the form is completed and submitted by the brand /company
The subscription fee maybe changed without prior notice.
Any change in subscription fee will not affect existing subscriber's current plan.
Subscriptions are limited and can be closed at anytime.
Any preferred design style must be communicated at the time of subscription in the subscription form.
the8020 does not provide intellectual property rights to the brand / company or the subscriber.
the8020 retains all intellectual property rights of all of the design / artworks delivered to the brand / company.
Some licenses / intellectual property are owned by different people which is being legally used by the8020
The subscriber can only use / publish the artwork once and as a social media post only.
The subscriber cannot use the artwork on any other medium without prior notice to the8020
The subscriber cannot modify /change the artwork created by the8020 for any reason and can only use as it is.
The subscriber allows the8020 to take legal actions if the artwork is misused in anyway.
the8020 will do its best not to duplicate any design for its subscribers but if it happens it purely co-incidental and the8020 cannot be held responsible morally or legally.
the8020 creates its own designs or sources / purchases its assets like illustration, images etc for design purposes from the internet legally. If there are any resemblance to any artwork in the internet to that of the Festival Artwork delivered by the the8020 then the8020 cannot be held responsible legally or morally since many companies, agencies or freelance designers have also access to the same.

Disclaimer

the8020 retains all rights to deny its Subscription to any entity and is not obliged to justify the same

the8020 will not be held responsible for actions, services, damages directly or indirectly.

the8020 may or may not involve 3rd party service providers to perform the tasks or subscription

the8020 retains all rights to return / refund the Subscription fee post payment and thereby cancel its services to any brand / company in case of any conflicts, problems or challenges including but not limited to any Intellectual property issues

This page is used to inform website visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to opt for our services through www.the8020.in or any method online or offline.

The personal information provided through this website or through any other means to the8020 is voluntary only. We will use this information only to provide the services mentioned in this website www.the8020.in only.
